A relocation analysis begins with the operative custody order, including any later modification. Read the legal-custody provisions, physical-custody terms, parenting calendar, school designation, transportation clauses, and notice requirements together.
Labels do not always describe how a family actually shares time. Compare the written order with a representative calendar and note any long-standing agreed practice. The legal framework can differ depending on the current arrangement and the requested change, so it is risky to assume that “primary,” “joint,” or a percentage estimate supplies the complete answer.
We organize the order history and actual schedule before analyzing a proposed move. This keeps the case tied to the orders the court is being asked to revise and prevents a broad relocation narrative from obscuring the child's current parenting structure.
List every term the move would affect. A new residence may change school enrollment, weekday parenting, exchanges, holidays, travel, extracurricular activities, healthcare access, and the practical operation of joint legal custody. Some terms may remain workable even when others require replacement.
The moving parent's proposal should state exact replacement language. The responding parent's alternative should do the same.
